This decision followed discussions between President Trump and Chinese President Xi Jinping as part of a broader agreement whereby China temporarily suspended its export licensing system for rare earth metals.<\/p>\n\n\n\n<p>In short: implementation has been put on hold politically, but the direction remains clear.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What does the Affiliates Rule entail?<\/h2>\n\n\n\n<p>The rule stipulates that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any foreign entity that is at least 50% owned by one or more parties on the Entity List, the Military End-User List, or other US sanctions lists (such as Specially Designated Nationals) will be subject to the same export and re-export restrictions as the parent entity.<\/li>\n\n\n\n<li>The restriction also applies when several sanctioned shareholders jointly reach the 50% threshold.<\/li>\n\n\n\n<li>Objective: To prevent sanctioned companies from gaining access to US technology or products through foreign affiliates.<\/li>\n<\/ul>\n\n\n\n<p>In short: If you are at least half-owned by a sanctioned party, the same export rules apply, even if you yourself are not on a list.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What does the delay mean?<\/h2>\n\n\n\n<p>The announcement on October 30 gives companies some temporary breathing space.
